Lawsuit filed against the Baldwin Park Unified School District alleges a security guard failed to intervene and the School Denied Medical Attention Aid to the Student following a fight at Baldwin Park High School in October.
Attorneys representing the 16-year-old female told Baldwin Park News that the lawsuit was filed last week.
In the lawsuit acquired exclusively by Baldwin Park News, named the Baldwin Park Unified School District, Baldwin Park High School Security Guard Identified as Mando/Amado, and Baldwin Park High School Principal Eric Lopez.
According to details in the lawsuit, on Wednesday, October 18, 2023, at approximately 1:00 p.m., a 16-year-old female student was physically and brutally attacked at school by another student named Emily in the women’s bathroom on campus.
Emily followed the 16-year-old female into the bathroom and waited until the 16-year-old female exited one of the stalls, according to the Lawsuit.
Soon after the 16-year-old female exited the stall, Emily attacked her, punching her, according to the Lawsuit.
Claimant attempted to escape, but Emily was too aggressive and prevented her from doing so, the bathroom door was also blocked by spectators, according to the Lawsuit.
According to the Lawsuit, it was evident the aggressor had premeditated the assault.
Given the crowd gathered outside the bathroom door, filming and cheering, the lawsuit added.
Among the spectators and witnesses to the fight was Baldwin Park High School Security guard identified as Mando/Amado, who could be seen laughing throughout the fight in a video, according to the Lawsuit.
Neither Amado/Mando nor any other school employee attempted to assist the 16-year-old female at any point, the lawsuit said.
Claimant was terrified and frantic after the attack; she was in pain, and her nose was bleeding nonstop, according to the lawsuit.
Claimant was never given or received medical attention by school personnel, according to the Lawsuit.
Claimant sought help by contacting her mother, the Lawsuit said.
Instead, it was her mother who called 9-1-1 upon learning about the attack, the Lawsuit obtained by Baldwin Park News said.
Upon her mother’s arrival at the school, the claimant’s mother proceeded directly to the office.
School administration and office personnel were unaware that the Claimant had been attacked, according to the Lawsuit.
Another school security guard eventually escorted the Claimant to the nurse’s office.
Following the incident, paramedics transported the 16-year-old female to the hospital, where she was diagnosed with a fractured nose, according to the lawsuit.
A Battery report was subsequently filed with the Baldwin Park Police Department, according to the Lawsuit.
Baldwin Park Police Department Detective Bureau was investigating the incident, Baldwin Park Police told Baldwin Park News.
Attorneys representing the claimant, in a phone interview with Baldwin Park News, described this incident as one of the most severe cases they’ve encountered.
Attorneys representing the claimant called Los Angeles County District Attorney George Gascón to bring charges against the security guard for “contributing to the delinquency of a minor.”, according to the Los Angeles Times.
According to the lawsuit, claimants experienced significant losses, including past, present, and future pain and suffering, severe emotional distress, mental anguish, medical expenditures, and expenses and costs of psychological long-term care, therapy, and counseling.
Baldwin Park Unified School District issued a written statement to Baldwin Park News saying, “The safety of our students is the District’s highest priority. We cannot comment further on any potential litigation.”
