Local activists questioned why various City Officials put a “hold” on a new city attorney, later discovered the City Attorney contributed and hosted fundraiser events on behalf of City Officials Campaign Elections.

Robert Tafoya, Baldwin Park’s City Attorney blasted attorneys for money on behalf of City Officials Campaign Elections.

In a photo obtained by Baldwin Park News, showed the event had different prices, ranging from $1,000 if someone bought Bronze level, $1,500 if someone bought a Silver level, and $2,500 if someone bought the Gold level. 

Monica Garcia, a Council Member, would benefit from Tafoya’s fundraising efforts.

Council Member Daniel Damian brought up an RFP (Request for Proposal) for a City Attorney at a Baldwin Park City Council meeting on April 21, 2021, to seek a new legal firm for the City of Baldwin Park.

However, despite the fact that the current City Attorney, Robert Tafoya, is under investigation by the Federal Bureau of Investigation, most city officials did not want a new city attorney.

Multiple Baldwin Park Council Members obstructed the discussion by Council Member Daniel Damian.

The Mayor Pro Term of the City, Alejandra Avila stated that she wished “to hold off” on looking for a new city attorney.

Council Member Paul Hernandez stated that he is “comfortable with the services that we’re providing . . . I don’t feel like we should put out an RFP [Request for Proposal].” 

Council Member Monica Garcia “questioned if it was the right time for this”. Garcia made the third request to put a search for a new city attorney, “on hold”. 

Officials claimed at the City Council Meeting held on April 21, 2021, that they didn’t want a new attorney due to the current lawsuits against the city and a new CEO.

However, a closer examination reveals that Tafoya is not managing any large suits.

Tafoya is not involved in any major lawsuits filed against the city for alleged wrongdoing by officials. They’re managed by the Leal Trejo APC.

Tafoya has a money trail that can be traced back to the three members of the council.

Council Member Avila reported receiving $4,457.79 in campaign contributions from Robert Tafoya and his law firm between January 1, 2018, and October 20, 2018, according to her California Form 460. Avila also got $1,500 from Albright, Yee & Schmit, a Tafoya subcontractor.

Council Member Monica Garcia reported that she received $8,800 from Tafoya and his law firm between January 1, 2017, and September 19, 2020, according to her California Form 460.

Also, Garcia received significant contributions from those affiliated with Tafoya. Cristeta Paguirigan-Summers gave $13,200. Cristeta is also affiliated with Albright, Yee & Schmit, who gave $2,000. David Olivas gave $2,000. Leal & And Anthony Willoughby II gave Garcia $2,000. 

Willoughby II is currently at the center of an alleged scandal regarding his employment and marijuana distribution licenses, who was hired by Robert Tafoya and is now working on the opposite side, whose father is an attorney for an official connected to a cannabis probe.

Willoughby II is a managing attorney at Willoughby and Associates, a firm run by his father, Anthony Willoughby Sr. 

However, the firm is indirectly connected to Baldwin Park through a different client. 

Willoughby Sr. is the personal attorney of Compton Councilman Isaac Galvan who was also raided by the FBI in late October.

Both Willoughby Sr. and Tafoya have donated to Galvan’s campaigns in the past, according to public records.

Monica Garcia would also receive money from Leal Trejo APC,  which is representing City Officials accused of corruption.

Council Member Paul Hernandez reported that Tafoya contributed $6,000 from Robert Tafoya and his law firm between October 12, 2018, and June 30, 2019, according to his California Form 460. 

Hernandez also received $3,500 from CA Education Coalition PAC, which is tied to Pacheco, Michael Taylor, and other additional money. Including Albright $1,000, and the Kauffman law firm $2,000.

Baldwin Park News reached out to all three City Officials for a statement but we never heard back.

In a request for a statement to Tonia Calloway Smith, Tafoya’s assistant, Baldwin Park News asked, what did they get in return from all of the levels such as the Bronze level, Silver level, and Gold level but no statement was returned.

On a City Council Meeting held on May 5, 2021, Local Activist Greg Tuttle during the public comments said  “This is a conflict of interest and we have shifted all paperwork to the DA Office Integrity Division which has a new leader now and is very interested in the case”

On that same City Council Meeting held on May 5, 2021, Local Activist John Rio’s during a public council meeting said, “how come we still have that lawyer that we have right now, that three of the city council voted not to replace him at this point”

 John Rio’s also commented “one of the many things concerns that we got rid of three bad apples starting with the ex-mayor, Pacheco, and jenny, now we have three more that are getting paid off because they are getting money from the lawyer, this is ridiculous what came out on the news right now, who is running the city council the lawyer or you, that one of the bad thing” 

“This is getting ridiculous what they are doing, if you they are not doing anything for the community, they really are not doing anything for us” 

On the Council Meeting held on April 21, 2020, Council Member Danial Damian said “Council Member Garcia I want to assure you that this has nothing to do with any tribune articles” “It has nothing to do with empowering anyone and it absolutely has nothing to do with being reactive” 

“My My reason to bring this on to the agenda are for things I observed myself, I spoken about myself, nothing to do with anyone, in particular, no articles, none of that, because at the end of the day I don’t allow for any of that to make my decision, I make my decision based on what I feel its the best for the City and the Community”

FBI Raid 

The FBI raided the Baldwin Park City Attorney’s office and other officials in late October as part of an ongoing investigation. According to the Los Angeles Times, the investigation is part of dealing with cannabis businesses, according to sources familiar with the probe, but no arrest was made.

After a former Baldwin Park Police officer claimed in a governmental claim that he had received complaints from three cannabis operations alleging “questionable business practices,” including payment of up to $250,000 cash in a brown paper bag sent to former mayor Manuel Lozano and the City of Baldwin Park.

In a new lawsuit filed in February claimed, the officer reported to the FBI at various times illegal conduct by high-ranking officials from the City of Baldwin Park, learned that police chief’s were told by city officials that any contact with the officer who reported the illegal conduct would result in their termination according to the lawsuit.

In an undercover operation, the officers became aware that one marijuana permit was tied to Lozano and his brother, a convicted criminal felon according to the suit.

On approximately January 27, 2019, the City’s Finance Director Rose Tam, indirectly accused an officer of having informed the Department of Justice and other investigatory agencies to open an investigation on the City of Baldwin Park’s finances, as well as the local Water Board.

Beginning in 2019, the officer was blamed by several high-ranking Baldwin Park officials for an FBI investigation into Baldwin Park, and state audits of the city as well as the local Water Board according to the lawsuit.

The officer was told by the acting Chief’s that certain City Council members hated the officer. 

The officer would have learned certain city employees were told by the city to keep tabs on the officer and his activities on and off duty, according to the lawsuit.

After, the City Council learned that the unit was targeting Latino gangs, and alleged criminal behavior by Lozano, and his brother, a convicted felon concerning Cannabis businesses.

City officials falsely represented the unit, claiming they were corrupt and under internal investigation. The allegations harmed the individuals because of the false and fabricated allegations, according to the lawsuit.

The officers were sharing some of the information with outside agencies because they were concerned the Baldwin Park Police Department would cover up the illegal activities, according to the lawsuit. 

The City Council did not want to investigate Latino gangs or the cannabis businesses to proceed. They asked the acting Chief of Police to shut down the unit.

The undercover operation put the individual’s families in jeopardy of being killed. Neither of them could take the risk of being exposed or potentially killed, so they had to leave the Baldwin Park Police Department for their safety, according to the lawsuit.

Lawsuits and allegations

The current City Attorney has had a long history of lawsuits and allegations.

Including problems have ranged from alleged excessive billing and drafting contracts, that stated that a police chief could only be fired if he was convicted of a felony according to the Los Angeles Times.

Tafoya also lied to a judge on several occasions, in a West Valley Water District lawsuit.

On September 10, 2015, the court clerk called the sheriff after Robert Tafoya, threatened to strike the Petitioner’s attorney outside in the court hallways. 

Tafoya was sanctioned with $36,000 by the court by filing a fraudulent disability lawsuit, placing a criminal doctor on the stand that had no personal knowledge of the case, and then walking out on his client’s trial entirely.

In a lawsuit filed on May 5, 2020, the City of Baldwin Park and Finance Director Rose Tam, was accused of laundering $7 million of state and federal housing funds, which were meant for low-income residents of the City of Baldwin Park, and co-mingling it with other funds.

In the complaint, the victim alleges she was wrongfully terminated, bullied, and racially discriminated against, amongst other claims, by the City of Baldwin Park; CEO Shannon Yauchtzee; City Attorney, Robert Tafoya; and Tam. 

After complaining about their hiring practice, and accusing Tam of misappropriating $7 million and being “bullied on multiple occasions.

John Rio también comentó “una de las muchas cosas se refiere a que nos deshicimos de tres manzanas podridas comenzando con el ex alcalde, Pacheco, y jenny, ahora tenemos tres más que están recibiendo dinero porque están recibiendo dinero del abogado, esto es ridículo lo que salió en las noticias en este momento, que está dirigiendo el ayuntamiento el abogado o usted, que una de las cosas malas”

En la Reunión del Consejo celebrada el 21 de abril de 2020, el miembro del Consejo Danial Damian dijo: “Miembro del Consejo García Quiero asegurarle que esto no tiene nada que ver con ningún artículo de tribune” “No tiene nada que ver con empoderar a nadie y absolutamente no tiene nada que ver con ser reactivo”

“Mi razón para llevar esto a la agenda es por cosas que observé, hablé de mí mismo, nada que ver con nadie, en particular, no hay artículos, nada de eso, porque al final del día no permito que nada de eso tome mi decisión, tomo mi decisión basada en lo que siento que es lo mejor para la Ciudad y la Comunidad”

Redada del FBI

El FBI allanó la oficina del Fiscal de Baldwin Park City y otros funcionarios a fines de octubre como parte de una investigación en curso. Según Los Angeles Times, la investigación es parte del trato con los negocios de cannabis, según fuentes familiarizadas con la investigación, pero no se realizó ningún arresto.

Después de que un ex oficial de Policía de Baldwin Park afirmara en un reclamo gubernamental que había recibido quejas de tres operaciones de cannabis alegando “prácticas comerciales cuestionables”, incluido el pago de hasta 2 250,000 en efectivo en una bolsa de papel marrón enviada al ex alcalde Manuel Lozano y a la ciudad de Baldwin Park.
