On Thursday, January 28, 2021, the convictions for first-degree murder were upheld for Man and Nephew in killing outside a Baldwin Park restaurant that took place in 2016 at Mariscos Uruapan Restaurant.
The men tried to appeal the incident in a court of the State of California second appellate district of Los Angeles County.
Omar Valenzuela Perez and Erik Armenta Perez tried to appeal their convictions for first-degree murder. In the 50-page appeal, the appellant contends were, the evidence presented was insufficient to support the verdicts; the trial court committed instructional and evidentiary errors, and abused its discretion by refusing the defense request for a mid-trial continuance; the prosecutor committed misconduct during closing argument, and the cumulative effect of the purported errors was prejudicial.
But the Court of Appeal rejected the defense’s contention that there was insufficient evidence to support the first-degree murder convictions of the shooting of Alberto Calvillo.
On October 22, 2018, Omar Valenzuela Perez and Eric Armenta Perez were found guilty of first- degree murder. The Basset man and his nephew were sentenced to life in prison for the murder of a man outside of a Baldwin Park restaurant in 2016, according to the Los Angeles County District Attorney’s Office.
The jury found true allegations that a handgun was used in the murder.
On November. 6, 2016, Omar Perez got into a verbal argument with victim Alberto Calvillo, of age 24. According to evidence presented in court, Omar Perez shot Alberto Calvillo to death with a gun provided to him by his nephew and they both fled.
According to the appeal Omar Valenzuela Perez and Eric Armenta Perez, Erik’s uncle, were three years older than Erik. Approximately a month and a half before they were charged with murder.
Prior to that time, the men had met only twice.
Erik Perez and Omar Perez had no confrontation or issue with Calvillo while inside the restaurant. Omar Perez made loudly derogatory remarks about women according to the appellate court panel’s ruling.
Meanwhile, Erik Perez walked through the parking lot, entered a Toyota Camry, and drove it to the driveway in front of the restaurant. Left the engine running, and remained in the car. Erik Perez opened the door and handed Omar Perez a gun.
Omar Perez then ran back up the ramp to the front of the restaurant, shot Calvillo multiple times, ran back down the ramp to the Camry, and entered the front passenger seat. Erik Perez drove them from the scene according to the appellate court panel’s ruling.
The justices found that there was no question that the actions of the nephew, “aided and encouraged the murder.”
In a Court appearance, Erik Perez explained he retrieved the gun because he was afraid Calvillo was going to “do something” to him and Omar Perez, and “because of the drugs” they were on. He did not know or intend that Omar Perez would kill Calvillo according to the appellate court panel’s ruling.
Calvillo was transported to a hospital, but did not survive and was later declared deceased. The entire incident, from when the individuals came outside until the shooting, lasted just over three minutes. Police officers stopped the Camry within 15 minutes of the murder.
Calvillo suffered multiple shots. The wounds to the shoulder and chest would have been fatal.
