The City of Baldwin Park received its newest lawsuit by relatives of a Covina couple that were killed during a police pursuit in 2019. The relatives of the couple that were killed in the pursuit, put a lawsuit against one other city and the State.
The lawsuit was placed at a Los Angeles Superior Court on Wednesday, December 9, 2020. The lawsuit states negligent actions were taken by three police department agencies and the driver they were trying to pull over, which led to the deaths of two victims.
The cities on the lawsuit were the City of West Covina, Baldwin Park, and including the state. Which have jurisdiction over the California Highway Patrol. As the California Highway Patrol’s Major Accident Investigation Team was handling the investigation into the crash.
The victims had been recently married and were headed home with their son on October 12, 2019. When the suspect was fleeing from police in a stolen Jeep. The events leading up to the deadly crash began with a report of a carjacking near the Teen Center and Skatepark in the 15000 block of Badillo Street in the City of Baldwin Park.
The vehicle owner’s cellphone had a GPS that was left inside the Jeep. The Jeep was seen about 2:00 am. On October 12, 2019, but instead of continuing to track the suspect, to avoid a police pursuit, the police agencies demanded he would be pulled over even though he posed no threat to anyone and there was no emergency, according to the lawsuit.
The actions caused the suspect to panic, and refuse to obey the request, and proceed to speed away, according to the lawsuit. The stolen vehicle was seen driving into the City of West Covina, and the Baldwin Park Police Department notified the West Covina Police Department.
The lawsuit alleges, the suspect and the pursuing officers, ran a red light, all crashed into the car containing the couple and the woman’s son. All three victims were ejected from the vehicle. The victim’s son survived the crash and is one of the plaintiffs in the lawsuit. The lawsuit claims wrongful death and motor vehicle negligence. The plaintiffs are seeking unspecified damages.
The plaintiffs believe that none of the police cars had their emergency lights on, or their sirens active. The collision caused injuries to the adult male, on his spine and neck and was later declared deceased. The adult female suffered injuries to her abdomen that also was declared deceased.
The woman’s son sustained “massive” injuries from the collision and had multiple surgeries at a hospital, where he was placed in a coma for weeks according to the lawsuit. He will spend the rest of his life recovering from his injuries. The collision occurred due to the “grossly negligent, wanton and reckless conduct” of the suspect and the police officers, the lawsuit states.
This hasn’t been the only lawsuit involving the City of Baldwin Park.
On May 5, 2020, a lawsuit was filed against the City of Baldwin Park and Finance Director Hong Tam, also known as Rose Tam or Hong Fang, as she was accused of laundering $7 million of state and federal housing funds, which were meant for low-income residents of the City of Baldwin Park, and co-mingling it with other funds.
In the complaint, the victim alleges she was wrongfully terminated, bullied, and racially discriminated against, amongst other claims, by the City of Baldwin Park; CEO Shannon Yauchtzee; City Attorney, Robert Tafoya; and Finance Director, Tam. After complaining about their hiring practice, and accusing Tam of misappropriating $7 million and being “bullied on multiple occasions.
In approximately 2017 Taylor was replaced by Salcedo, Salcedo was hired and only lasted 46 days approximately. He now has a lawsuit against Baldwin Park. Chief Hadsell sued and is owed around $9,000,000. Chief McLean among five to ten officers including City municipal employees, filed a lawsuit. Officers Mark Adams and Chris Kuberry sued the City previously and won several hundred thousand dollars.

La demanda alega, el sospechoso y los oficiales que persiguen, corrieron una luz roja, todos se estrellaron contra el coche que contenía la pareja y el hijo de la mujer. Las tres víctimas fueron expulsadas del vehículo. El hijo de la víctima sobrevivió al accidente y es uno de los demandantes en la demanda. La demanda reclama muerte injusta y negligencia de vehículos de motor. Los demandantes están buscando daños no especificados.
Los demandantes creen que ninguno de los coches de la policía tenía sus luces de emergencia encendidas, o sus sirenas activas. La colisión causó lesiones al macho adulto, en su columna vertebral y cuello y más tarde fue declarado fallecido. La hembra adulta sufrió lesiones en su abdomen que también fue declarada fallecida.
El hijo de la mujer sufrió lesiones “masivas” por la colisión y tuvo múltiples cirugías en un hospital, donde fue colocado en coma durante semanas según la demanda.
Pasará el resto de su vida recuperándose de sus heridas. La colisión ocurrió debido a la “conducta gravemente negligente, desenfrenada e imprudente” del sospechoso y los agentes de policía, según la demanda.
Esta no ha sido la única demanda que involucra a la Ciudad de Baldwin Park.
