More officers have come forward accusing City officials of allegations and claims, multiple officers have a lawsuit against City officials and the City of Baldwin Park now. One more officer filed a claim, Some of the officers are current or former employees of the Baldwin Park Police Department. The claims are for Retaliation, corruption, discrimination, harassment under the Fair Employment and Housing Act, WhistleBlower, and more.
On June 3, 2020, in the evening, during a City Council meeting, former City Clerk Jean Ayala read a 10 minute long “anonymous letter” from an officer in the police department during the public comments period. At that same meeting, McLean accused Lozano, City Attorney Robert Tafoya, Vice Mayor Paul Hernandez, and Chief Executive Shannon Yauchzhee of being corrupt. McLean said, “The corruption stops tonight”.
The accusations on the letter were false according to Mr.McLean claim. The claims of racism brought by the anonymous letter were written by, the wife of Officer Francisco “Frank” Real and read during a City Council Meeting by the Former City Clerk Jean Ayala with permission from Mayor Manny Lozano. The Letter on June 3, 2020, was the second “anonymous letter” where Lozano accused Baldwin Park Police Department employees of racism according to the claim.
Former Cheif of Police Taylor’s first term, an anonymous letter reportedly surfaced at the Baldwin Park Police Department, which was published on a Whistleblower website accusing Taylor of being a racist and engaging in cronyism. The allegations were false. Lozano in an open council meeting claimed Taylor was racist and fired him according to the claim.
The “anonymous letter” of June 3, 2020, was sent beforehand as part of an email disclosing that Ms. Real was at least one of the “anonymous letter’s” authors according to the claims. The reason that Mrs. Real wrote the letter, was that she wanted to prevent the Chief of Police Steve McLean from having a fair examination process to promote Baldwin Park Police Department employees to the rank of Sergeant and Lieutenant.
Before the letter was written, read, and republished to attack Chief McLean there were multiple attempts by Mayor Manny Lozano; Vice Mayor Paul Hernandez; and Former City Clerk Jean Ayala to dissuade Chief McLean from conducting fair promotional examinations without regard to the employee’s race or national origin.
Lozano did not want to consider the content of the applicant’s test, but rather the color of their skin. The letter also violated multiple California Code Sections, the public comments are limited to three minutes but lasted at least five minutes. The letter was not anonymous, it was forwarded to Ayala from Mrs. Real the wife of officer Real. The claim also said because the letter involved personnel matters, the Mayor should not have allowed the process to continue as it was a violation. The “anonymous letter” read by Former City Clerk Jean Ayala was read in violation of city rules.
The author of the letter, Flor Real, her husband, Francisco “Frank” Real, Former City Clerk Ayala, Mayor Manny Lozano, Vice Mayor Paul Hernandez, and City Attorney Robert Tafoya are all reasonably understood that the defamatory statements were about Chief McLean’s business and profession and that they would be particularly damaging. The statements were false. The letter was published due to Chief McLean, had investigated, disciplined, and fired officers for uses of force.
The defamatory “anonymous letter” continued to damage the reputation of Acting Captain Findley, by harming his reputation in the community. Findley was also denied promotional opportunities when the promotional list that he was on, was rescinded at the direction of Lozano. At the time, Findley was at the top of the list and there were promotional opportunities.
Three officers who did poorly on exams in the past would promote regardless of merit. Those officers were Jorge Huerta; Gonzalo Cetina and Francisco “Frank” Real according to the claim.
The defamatory comments on the “anonymous letter” caused harm to Chief McLean’s business, trade, profession, and occupation. It has will result in lost earnings, lost earning capacity, and lost pension benefits because it has lead to the constructive discharge of Chief McLean who is now forced to retire because of the emotional distress, shame mortification, and hurt feelings caused to him from this defamation. The letter was written with malice and it was known to the author(s), to the reader, and to the Mayor to be false when it was written.
The defamatory and inflammatory letter was read purposely the night before peaceful protests were scheduled for the City. It was well known, that Chief McLean planned to “take a knee” and show his support for peaceful demonstrations for change so that all people can be treated fairly and equally.
The Chief Executive Shannon Yauchzhee tried to through an Acting Chief to set up false accusations of the plaintiff according to the claim.
Lozano let the Chiefs know if they did not promote the people he wanted, he would fire them. Chief Lili Hadsell told several employees that if she promoted Mark Adams or Chris Kuberry, she would be fired by Lozano and Councilmember Marlen Garcia. Hadsell told several high ranking employees that the Council would go after her for promoting Kuberry or Adams even though they were numbers 1 and 2 on the exam.
The actions of the defendants and each of them were reckless and dangerous according to the claim. Their conduct put the community at risk and endangered the community. The anonymous letter by Mrs. Real and others is on YouTube still. It continues to be republished. The City and defendants were asked to issue a retraction, but they refused. Ayala was appointed to the council after reading the defamatory letter.
This hasn’t been the only lawsuit. In approximately 2017 Taylor was replaced by Salcedo, Salcedo was hired and only lasted 46 days, approximately, he now has a lawsuit against Baldwin Park. Officer Kuberry filed his first lawsuit in 2011 and settled in 2013. Officer Kuberry was discharged on November 9, 2019, according to the claim. Chief Hadsell sued and is owed around $9,000,000. Chief McLean among and Five officers have filed governmental claims. Officers Mark Adams and Chris Kuberry sued previously and won several hundred thousand dollars.

La jefa Lili Hadsell dijo a varios empleados que si promovía a Mark Adams o Chris Kuberry, sería despedida por Lozano y la concejal Marlen Garcia. Hadsell dijo a varios empleados de alto rango que el Consejo iría tras ella para la promoción de Kuberry o Adams a pesar de que eran los números 1 y 2 en el examen.

Esta no ha sido la única demanda. En aproximadamente 2017 Taylor fue reemplazado por Salcedo, Salcedo fue contratado y solo duró 46 días, aproximadamente, ahora tiene una demanda contra Baldwin Park. El oficial Kuberry presentó su primera demanda en 2011 y se estableció en 2013. El oficial Kuberry fue dado de alta el 9 de noviembre de 2019, según el reclamo.
