Lawsuit has been filed against the City of Baldwin Park and the Baldwin Park Police Department, alleging that an officer or multiple officers used excessive force by slamming a plaintiff’s head into the concrete during an arrest on May 4, 2024.
Plaintiff, who submitted a 10-page lawsuit on February 6, 2025, is seeking damages for wrongful arrest, excessive use of force, retaliation, and municipal liability.
While the lawsuit does not currently name the officer or officers involved at this time, it outlines details of the alleged incident, which resulted in the plaintiff sustaining serious injuries.
According to the lawsuit on May 4, 2024, the plaintiff was walking home alone after dining at a local Mexican restaurant when he suddenly suffered a severe seizure.
His medical episode caused him to lose consciousness, and upon regaining awareness, he attempted to continue his walk home to seek assistance from his family.
As he neared his residence just across, he was approached by multiple Baldwin Park Police Department officers who ordered him to stop and place his hands behind his back.
Plaintiff later discovered that Baldwin Park Police Department officers claimed he resembled a person involved in a nearby altercation, according to the lawsuit.
However, the plaintiff did not match the described individual, as he was wearing different colored clothing, and he had not been involved in any fight.
He was merely attempting to reach the safety of his home following a medical emergency.
Plaintiff questioned why he was being detained, entirely confused, was met with hostility, according to the lawsuit.
Baldwin Park Police Department officers refused, questioning why he was being detained. Instead, Baldwin Park Police Department officers were yelling at Plaintiff to put his hands behind his back and “stop resisting,” the lawsuit added.
In an effort to comply, he even asked to be handcuffed, which officers proceeded to do without further incident at that point.
However, tensions escalated when the plaintiff allegedly referred to the Baldwin Park Police Department officers as “crooked ass cops” and demanded an explanation for his arrest.
In response, one unidentified Baldwin Park Police Department officer or officers allegedly grabbed the plaintiff by the neck and commanded him to “shut the fuck up.”
Plaintiff called out to nearby bystanders to record the incident; moments later, the same unidentified Baldwin Park Police Department officer or officers reportedly retaliated by slamming the plaintiff’s head into the concrete, the lawsuit added.
The impact of this act resulted in significant physical injuries to the plaintiff, while his family members, who had witnessed the incident from across the street, looked on in distress, according to the lawsuit.
Following the incident, Baldwin Park Police Department officers filed an official report, which claimed that the plaintiff was arrested for public intoxication and resisting arrest.
However, the lawsuit alleges that these charges were fabricated and lacked any legitimate basis.
On June 20, 2024, the Los Angeles County District Attorney’s Office declined to pursue any charges against the plaintiff, citing insufficient evidence to support the officers’ claims.
As a result of the alleged excessive force, the plaintiff suffered physical trauma, particularly to the head, and has endured ongoing emotional distress.
Its lawsuit aims to hold the City of Baldwin Park and its Baldwin Park Police Department Officers accountable for the actions that led to the plaintiff’s injuries.
