Lawsuit filed in a Los Angeles County Superior Court alleges medical malpractice against Kaiser Permanente Baldwin Park Medical Center and one of its cardiology employees.
In court documents obtained by Baldwin Park News, the seven-page civil lawsuit was filed on April 3, 2025, and names multiple defendants.
Including Kaiser Permanente Baldwin Park Medical Center, Kaiser Foundation Hospitals, Kaiser Foundation Health Plan, Inc., the Southern California Permanente Medical Group, and Jabar S. Whittier, M.D., a cardiologist employee at the Baldwin Park facility.
Plaintiffs are seeking a jury trial, claiming medical negligence and loss of consortium stemming from the incident that unfolded earlier last year.
On January 6, 2024, Plaintiff presented to Kaiser Permanente Baldwin Park Medical Center with symptoms and complaints of elevated blood pressure, palpitations, dizziness, and lightheadedness during and throughout the previous week – with a single syncope episode reported.
Plaintiff was evaluated in the emergency department, at which time EKG/ECG was noted as being remarkable for complete heart block, according to the lawsuit.
Subsequently, Plaintiff was seen in consultation by a cardiologist, Jabar S. Whittier, M.D., and it was recommended that a pacemaker be inserted the following morning, its lawsuit alleged.
On January 7, 2024, Plaintiff underwent cardiac pacemaker insertion by/with Jabar S. Whittier, M.D., the lawsuit mentioned.
During which a Boston Scientific Accolade MRI IS-1 Pacemaker was implanted – including an atrial lead (Boston Scientific Ingevity+ Pacing Lead 52cm with active fixation of 1.8mm) and a ventricular lead (Boston Scientific Ingevity+ Pacing Lead 59cm with active fixation of 1.8mm).
The atrial lead was fixated and implanted at/into the right atrial appendage, while the ventricular lead was fixated and implanted at/into the right ventricular apex.
Later that same day, Plaintiff was cleared for discharge. Where she was discharged home.
On January 9, 2024, Plaintiff presented to Emanate Health Queen of the Valley Hospital via emergency transport due to symptoms and complaints of fatigue, weakness, lightheadedness, dizziness, and bradycardia.
At that time, EKG/ECG demonstrated third-degree heart block, while Boston Scientific interrogation revealed that her recently implanted pacemaker was not capturing or only intermittently capturing.
Plaintiff was admitted to the ICU for further evaluation, where work up was consistent, and the right ventricular pacemaker had perforated the ventricular wall, extended into the pericardial sac, and resulted in a pericardial effusion, its lawsuit alleged.
On January 13, 2024, Plaintiff was transferred and admitted to Emanate Health Inter-Community Hospital.
Where she immediately underwent subxiphoid pericardial window surgery with chest tube insertion for pericardial effusion secondary to pacemaker lead perforation of the right ventricle.
During which the decision was made to suture the old ventricular lead in place following insertion of a new ventricular lead at the intraventricular septum due to concern for increased bleeding upon removal of the original RV lead requiring further intervention.
Following surgery, Plaintiff remained hospitalized until January 18, 2024, during which time she required close monitoring and ongoing care and treatment of/for her severe injuries.
As a direct and proximate result of the negligent acts and omissions of Defendants, Plaintiff sustained serious and severe personal injuries, as well as pain, suffering, and mental and emotional anguish, distress, and anxiety.
As of the time of publication, Kaiser Permanente told Baldwin Park News’ regarding the lawsuit.
“While we cannot comment on personal health information or the specific circumstances of this case due to privacy laws, Kaiser Permanente provides excellent cardiac care services to our patients.”
Adding, “Furthermore, we are committed to ensuring every individual treated at our facilities receives the highest quality health care and treatment appropriate for their health condition.”
Demanda Alega Negligencia Médica por parte del Centro Médico Kaiser Permanente Baldwin Park y Empleado de Cardiología

El 7 de enero de 2024, el demandante se sometió a la inserción de un marcapasos cardíaco por/con Jabar S. Whitter, MD, alegó su demanda.
Durante el cual se implantó un marcapasos Boston Scientific Accolade MRI IS-1, que incluía un cable auricular (Boston Scientific Ingevity + Cable de Estimulación 52 cm con fijación activa de 1,8 mm) y un cable ventricular (Boston Scientific Ingevity + Cable de Estimulación 59 cm con fijación activa de 1,8 mm).
El cable auricular se fijó y se implantó en/en el apéndice auricular derecho, mientras que el cable ventricular se fijó y se implantó en/en el vértice ventricular derecho.
Más tarde ese mismo día, el demandante fue absuelto. Donde fue dada de alta en su casa.
El 9 de enero de 2024, el demandante se presentó al Hospital Emanate Health Queen of the Valley en transporte de emergencia debido a síntomas y quejas de fatiga, debilidad, aturdimiento, mareos y bradicardia.
En ese momento, el electrocardiograma / ECG demostró bloqueo cardíaco de tercer grado, mientras que el interrogatorio de Boston Scientific reveló que su marcapasos recientemente implantado no capturaba o solo capturaba intermitentemente.
El demandante fue ingresado en la UCI para una evaluación adicional, donde el trabajo fue consistente y el marcapasos del ventrículo derecho había perforado la pared ventricular, se había extendido hacia el saco pericárdico y había provocado un derrame pericárdico, según su demanda.
El 13 de enero de 2024, el demandante fue trasladado e ingresado en el Hospital Inter-Community Emanate Health.
Donde inmediatamente se sometió a una cirugía de ventana pericárdica subxifoidea con inserción de tubo torácico por derrame pericárdico secundario a perforación de la derivación del marcapasos del ventrículo derecho.
Durante el cual se tomó la decisión de suturar el cable ventricular antiguo en su lugar después de la inserción de un nuevo cable ventricular en el tabique intraventricular debido a la preocupación por un aumento del sangrado al extraer el cable del VD original que requería una intervención adicional.
Después de la cirugía, la demandante permaneció hospitalizada hasta el 18 de enero de 2024, tiempo durante el cual requirió un monitoreo cercano y atención y tratamiento continuos de sus lesiones graves.
Como resultado directo y inmediato de los actos y omisiones negligentes de los demandados, el demandante sufrió lesiones personales graves y graves, así como dolor, sufrimiento y angustia mental y emocional, angustia y ansiedad.
Al momento de la publicación, Kaiser Permanente le dijo a Baldwin Park News sobre la demanda.
